Toys R Us Net Unit Sued Over Deliveries

Toys R Us Inc.’s Internet division is being sued by a customer who claims it failed to deliver thousands of Christmas toys on time. Toysrus.com, which had online sales of $39 million from Nov. 1 to Dec. 25, received far more orders than expected and was forced to turn away a number of customers in November. The suit, filed in a Washington state court in Seattle, seeks class-action status on behalf of all customers who bought toys on the Web site by Dec. 14 but didn’t receive their purchases by Dec. 25. Among other things, it seeks a court order requiring Toysrus.com to refund its delivery charges and prohibiting it from making delivery guarantees on its Web site. Toysrus.com spokesman Stephen Jones said the division hasn’t seen the suit, which was filed Jan. 5, though the company asserted the claims are without merit. Shares of Paramus, N.J.-based Toys R Us rose 19 cents to close at $11.75 on the NYSE.
