Brea Power Sues Edison, Alleging $12 Million in Unpaid Bills
A small power supplier in Brea has filed a lawsuit alleging that Southern California Edison has failed to pay for $12 million in power.
Brea Power Partners contends it has not been paid for power delivered since November. The suit, filed in Los Angeles Superior Court, is at least the fifth by a small generator alleging that Southern California Edison has failed to pay. The suit names Edison International, which owns Southern California Edison.
Brea Power operates a landfill gas-fired 5-megawatt plant. The company says its gas supplier will not allow it to terminate the supply agreement, so Brea Power “is forced to continue” to use the gas to deliver power to Edison despite the utility’s failure to pay.
The lawsuit asks the court to allow Brea Power to pull out of its Edison contract so it can sell to another buyer. The generator said it seeks a court ruling because Edison may refuse to permit the necessary scheduling to pass power through Edison’s transmission system, which is connected to Brea Power’s plant.
