Land Compensation Measure Overturned
A property compensation measure that critics say could unravel Oregon’s nationally admired land-use laws was ruled unconstitutional by a judge.
The measure would require state and local governments to compensate property owners when regulations reduce the value of their holdings.
Circuit Judge Paul Lipscomb ruled against Measure 7 not because of its potential effect on land-use laws but because of what he said is a constitutional flaw.
He said the law encompasses too many changes for a single constitutional amendment. The ruling doesn’t address the intent of the law, considered the most sweeping property compensation law in the nation.
