Warning to Homeowners

A letter from Lefteris Lavrakas (“Subcontractor’s Lien Surprises Owner,” Nov. 4) suggested the Contractors State License Board should require a warning to homeowners of the possibility of a mechanic’s lien being filed against their property by persons other than their contractor. Actually, the “Notice to Owner” has been required by law for many years.

A licensed contractor is required to provide this notice when the original contract is signed. The required language is quite detailed, and may be found at https://www.cslb.ca.gov/hicontracts2a.html.

It appears that Lavrakas’ roofing contractor may have failed to provide this notice, something that is grounds for disciplinary action. Failing to pay subcontractors or material suppliers is also grounds for disciplinary action.
