Judge in Runnion Kidnap-Murder Case Is Replaced After Request by Defense

A new judge was appointed Monday to preside over the trial of a man accused of kidnapping and murdering 5-year-old Samantha Runnion after his lawyers accused the original judge of prejudice.

Alejandro Avila’s defense team did not explain the bias claim filed in court against Superior Court Judge F.P. Briseno. By law, attorneys are limited to one such request without having to give a reason.

“That’s a tactical decision I’m not going to discuss,” said Assistant Public Defender Denise Gragg.

Briseno was replaced by Judge William Froeberg.

Avila, 28, of Lake Elsinore, reentered pleas of not guilty to one count each of murder and kidnapping, and two counts of lewd acts on a child under 14.

He could face the death penalty if convicted.

Avila has waived his right to a preliminary hearing. He was ordered to return to court Friday, when a trial date could be set.

Orange County Dist. Atty. Tony Rackauckas said he would continue to press for a trial within 60 days, while Gragg indicated she needs more time.

Runnion was kidnapped July 15 as she played with a friend outside her Stanton home.

Her body was found the next day on a mountain road in Riverside County.
