Bolsa Chica Lawsuit May Proceed, Court Rules

A lawsuit against the California Coastal Commission filed by the developer and owner of the Bolsa Chica mesa may proceed, a state appeals court has ruled.

Landowner Signal Landmark and developer Hearthside Homes say the commission in effect took the property by so restricting what could be built that development is no longer economically feasible.

Hearthside now proposes 1,235 homes on the 230-acre mesa. But the Coastal Commission in November 2000 limited development to 65 acres on the upper mesa.
