D.A. to Decide Nov. 4 on Ex-Officers’ Retrial

An Alameda County Superior Court judge said Wednesday that the district attorney would decide Nov. 4 whether to retry three former Oakland police officers recently acquitted of corruption and abuse charges.

On Sept. 30, after a yearlong trial, a jury found fired officers Clarence “Chuck” Mabanag, Jude Siapno and Matthew Hornung innocent of eight charges that included kidnapping and beating suspects. Jurors were deadlocked on 27 additional felony charges, which Dist. Atty. Tom Orloff could decide to file again for a new trial.

The verdicts upset some community activists because the officers’ alleged victims were black and the jury that heard the case had no blacks on it.
