Judge Won’t Accept Appeals by Cooper

A U.S. District judge in San Diego has ruled in favor of prosecutors in the case of death-row inmate Kevin Cooper, who was convicted of a quadruple murder in Chino Hills in 1983 and who won a reprieve that spared him from execution last year.

Judge Marilyn Huff said she would not accept any more motions related to Cooper’s appeal, a move that will probably shift Cooper’s death penalty case to the U.S. 9th Circuit Court of Appeals.

The 9th Circuit delayed Cooper’s execution in February 2004, saying further testing was needed on hair and blood evidence.

Those tests implicated Cooper as the lone killer, according to recent court testimony.
