Man Shot After Told to ‘Get Up’ Files Claim

An Air Force policeman who was shot by a San Bernardino County sheriff’s deputy in Chino six months ago filed a claim Wednesday accusing the county of engaging in “unconstitutional policies” designed to cover up its use of illegal excessive force.

Those alleged policies “created an environment of lawlessness” in which such routine “misconduct was known by, tolerated, condoned and encouraged” by county law enforcement officials, according to the claim filed by Senior Airman Elio Carrion.

Neither a county spokesman nor a representative of the county counsel’s office was available for comment.

Carrion, 21, was shot Jan. 29 when the Corvette in which he was a passenger was stopped on a residential street after a brief chase. In a grainy, dimly lighted video surreptitiously recorded by a resident, Deputy Ivory John Webb Jr. is shown ordering the airman to “get up” from a prone position on the pavement, then shooting him three times as he attempts to comply.

Webb, 45, who later left the Sheriff’s Department, has pleaded not guilty to charges of attempted voluntary manslaughter stemming from the shooting and has a preliminary hearing set for Aug. 22.
