Review is asked of detainee trial
The Bush administration asked the 4th U.S. Circuit Court of Appeals in Richmond to reconsider its decision that an alleged Al Qaeda agent held in military custody since 2003 must be given a trial in criminal court.
A three-judge panel said accused terrorist Ali Saleh Kahlah al-Marri, a citizen of Qatar, must be criminally tried in a civilian court. The United States can no longer hold him without charges in a Navy brig in South Carolina, the judges said.
“The decision radically circumscribes the president’s authority to wage the ongoing military conflict against Al Qaeda,” the Justice Department said in a filing requesting a review by the full 12-member court.
