Health plans understand that consumers want to reform the process for rescinding health coverage and reached out to the Legislature to make improvements. Health plans support improved clarity in applications. Health plans support ensuring that consumers receive timely notice about questions of coverage. Health plans support using an independent third party to review rescission decisions.

Unfortunately, AB 1945 falls short of offering consumers real protections. It is a thinly veiled attempt by trial attorneys to file more lawsuits and leaves consumers with no choice but to engage in expensive, drawn-out court cases. Consumers don’t deserve to be held hostage by trial attorneys looking to make a buck.
