The city has asked a federal judge to change or repeal a 1983 injunction that increased the number of flights at the municipal airport from 15 to 18.
Pacific Southwest, Jet America and Alaska airlines won the injunction after the city took away one flight from each of them and reassigned them to other airlines flying quieter planes. U.S. District Judge Laughlin Waters then ruled that the city’s action was discriminatory and ordered that one flight each be reinstated to the three airlines.
“When the judge issued the injunction there was a certain state of facts before him, including the city’s noise ordinances,”said Deputy City Atty. Roger Freeman. “Those ordinances have been revised significantly and in our view avoid the legal concerns he had at that time.”
Also, Freeman said, the added flights have made the noise problem more severe for airport neighbors.
A hearing on the city’s request is expected in late January or early February, Freeman said.
