Fullerton : City Agency Files Suit to Force Sale of Structures

The city has gone to court to force three property owners to sell their buildings so that the city can tear them down and put up a parking structure.

In a document filed Tuesday in Orange County Superior Court, the Fullerton Redevelopment Agency exerted its eminent domain powers to condemn the buildings, located at Santa Fe and South Pomona avenues, and pay the three owners an appraised fair-market value: a total of $373,650.

The three properties consist of two houses owned by Frank and Ruth Rios, a pottery gallery owned by Carl Kymla and a battery shop owned by David, Arthur and Robert Schade.

The offer does not include what the agency must pay to relocate the businesses and the two families who live in the houses, said Robert Waldron, the agency attorney.

The action comes one week after the City Council voted to condemn the buildings, despite objections by Kymla, the Rioses and their tenants.

The $2.2-million parking structure is intended for commuters served by Amtrak, which has a station at the Fullerton Transportation Center across the street.
