A Superior Court judge Friday sentenced an El Cajon developer, who had admitted his guilt on six counts of real estate fraud, to 32 months in state prison, and ordered him to pay $639,302 in restitution as a “statement . . . (and) to protect society.” Richard A. McKee, 59, pleaded guilty in October to six counts of failing to disclose material facts to investors that, if known, would have persuaded them not to invest in a South San Diego condominium project. Superior Court Judge Norbert Ehrenfreund had postponed McKee’s sentencing to give him time to prove that he would be able to make restitution. But the judge said, “I have not seen a real effort forthcoming.” He also indicated concern that elderly people--25 of them in this case--have become victims of fraud. “We have a duty to protect that part of society,” he said. Deputy Dist. Atty. Charles Wickersham urged a four-year prison term, saying McKee spent only $197,000 of the $1.16 million he collected for a down payment on the land, and spent the rest on himself.
