San Onofre : Suit Seeks to Prevent Use of N-Plant’s Unit 1

The Sierra Club and Southern California Alliance for Survival have filed suit to stop the future operation of Reactor Unit 1 at the San Onofre nuclear power plant until it is further modified.

The suit, filed in the 9th Circuit Court of Appeals, seeks to overturn a November order by the Nuclear Regulatory Commission allowing Unit 1 to operate prior to completion of earthquake modifications.

More than half of the $240-million project already has been completed, utility spokesmen said.

The two groups filing suit had appealed the commission’s order but the NRC denied the appeal Feb. 19, according to documents filed with the suit.

The groups claim the commission should have held public hearings before approving the start-up, and they say there is no certainty that necessary seismic and structural improvements have been made.

A spokeswoman for the court said no hearing date has yet been set.
