After nearly five years of pretrial wrangling, a judge has dismissed former Orange County Supervisor Edison W. Miller’s libel suit against his 1980 campaign foe, current Supervisor Bruce Nestande, and 29 former Vietnam prisoners of war. Superior Court Judge Judith M. Ryan ruled that Miller, accused in a campaign letter of making statements that aided the North Vietnamese while he was a POW for more than five years, could not show that any of the defendants had acted with malice. A trial had been scheduled for May 13. Miller, 53, now is a Santa Ana lawyer. His attorney said an appeal was planned.
