Liquor Store Owner Won’t Be Charged in Wounding 2

No charges will be filed against the owner of a Garden Grove liquor store who shot and wounded a holdup suspect and a customer, police said Monday.

Sgt. Bruce Beauchamp said the case was presented to the district attorney’s office Monday, and that robbery charges were filed against the alleged bandit, Rock Lee Fetzer, 29, of Westminster, and an alleged accomplice, David Wooley, 24, of Irvine.

Police said Fetzer entered Cupp’s Liquor Store Friday night, wielding a tire iron, and demanded money from the cash register. The owner, Chun Le, 26, of Santa Ana, pulled out a .380 semi-automatic pistol and emptied her gun as Fetzer fled, police said.

Fetzer was hit in the back and underwent surgery at UCI Medical Center after he and Wooley were arrested at Wooley’s house about three hours after the shooting. A customer, Kurt Yenulonis, 19, of Santa Ana, was also hit by one of the bullets; he was treated and released at Fountain Valley Community Hospital.

Investigators said Fetzer, after he saw Le’s gun, bolted from the store and collided with Yenulonis, who was entering the store. Yenulonis said Friday night that both he and Fetzer went down in a heap, and that Le, at about that point, opened fire, wounding them both. Fetzer leaped up and escaped.

Beauchamp said he was told no charges would be pressed against Le because “there is plenty of case law that does make it a justifiable act (to shoot) when you’re the victim of a violent crime.” Even though Fetzer was hit as he was fleeing, “there was still violence going on,” Beauchamp said.
