A state court backed the sale of an MCI unit.

Delaware Chancery Court refused to block the sale of MCI’s paging and cellular-phone assets to McCaw Communications, Bellevue, Wash., for $120 million. Mobile Communications Corp. of America had claimed breach of contract after MCI, which originally agreed to sell to Mobile, later backed off on learning that Mobile intended to operate the systems with Atlanta-based Bellsouth, a spinoff of the old Bell System. Because Mobile failed to identify its partner at the time, the court said, it “assumed the risk” that MCI’s board would disapprove the sale. A separate court order obtained by Bellsouth on Aug. 12 still blocks the sale to McCaw.
