An appeals court judge temporarily lifted a gag order against a reporter who used secret grand jury testimony in a story about the drug and weapon case against former New York Yankee Joe Pepitone.
Associate Justice David Gibbons of the Appellate Division of State Supreme Court in Brooklyn, said New York Daily News reporter Daniel Hays could not be prevented from writing about the case until an appeals panel meets to hear the issue Monday.
