A federal appeals court ruled against the FCC.

The U.S. 11th Circuit Court of Appeals ruled unconstitutional a law that gave the Federal Communications Commission authority to decide how much cable-television companies should pay for stringing their cables on utility poles. The decision came in an appeal of a FCC order reducing the fee that Florida Power Corp. received from three cable companies. The FCC ruled under the 1978 Pole Attachments Act that Cox Cablevision, Acton CATV and Teleprompter Corp. were being overcharged by Florida Power.
