Hershey Foods Not Amused by Joke Rock Song : Suit Seeks Destruction of Sexually Graphic Record

“The Candy Rapper,” a rock song describing “a promiscuous sexual encounter” experienced by “Ms. Hershey,” prompted Hershey Foods to file suit Thursday in U.S. District Court here against Hadley D. Murrell, a Hollywood record producer.

Hershey, based in Hershey, Pa., contends that “The Candy Rapper” uses trademarked Hershey candy bar names without the company’s permission. The suit seeks destruction of the records, alleging that the song goes against the “wholesome family-oriented image” of its products.

Attached to the lawsuit was a cassette tape of the song and a copy of lyrics that describe a variety of graphic sexual acts.

“The record was a joke,” Murrell said in a telephone interview. “We did it last year in a garage.” The record was distributed nationwide by Murrell’s Borderline Thrill Music Inc.

Murrell said he manages Tim MacDonald and Bird, two nightclub performers who sing the song in what he described as an adult musical comedy show. Bird and MacDonald followed “The Candy Rapper” with a new album--”The Dukes of Disgusting.”

Murrell said he was surprised that the company filed suit. “When the lawyers from Hershey got this song, they had to laugh,” he said.
