An Alameda County Superior Court judge has ruled the state Labor Department cannot bar employers from hiring children for door-to-door sales work. Judge Winton McKibben issued a 90-day preliminary injunction in Oakland against the Labor Department in a case involving eight children and two firms, Bay Area Careers and Junior Careers. McKibben’s order prevents state labor officials from taking any action to stop children under 16 from taking door-to-door jobs unless employers violate other regulations, such as those requiring payment of the minimum wage and forbidding night work. David Hicks, attorney for the two companies, contended the Labor Department’s policy discriminated against the two employers, because the Department did not ban door-to- door sales by Campfire Girls, newspaper carriers and other minors.
