Supreme Court: ‘Strong on Law’
It was distressing enough to read your news account recently on the Supreme Court’s ruling that judges can still, despite Proposition 8, ignore a convicted felon’s prior record in sentencing, but now comes your editorial, commending the court for its action.
The convoluted and tortured reasoning apparent in Justice Otto Kaus’ opinion and in your editorial as well, is a prime example illustrating the widening gulf between the law and the ordinary citizen. It is becoming increasingly obvious that the justices decide a case a priori in accordance with their philosophy, and then instruct their law clerks to research for precedent or conflicting law. This is precisely the reason our criminal justice system is well on its way down the proverbial rat hole.
