Golf Course Loses Damages Claim

Los Coyotes Country Club’s insurance company has refused to pay a $591,943.97 claim for damages to a portion of the Fullerton club’s golf course, according to documents filed Monday in U. S. District Court in Los Angeles. The area in question was scheduled to be the staging area for a major toxic waste cleanup of the adjacent McColl dump.

On Monday, Wausau Underwriters Insurance Co., filed a lawsuit against McAuley Oil Co., the club’s owner, seeking a federal jury trial to support its decision not to pay the country club’s claims for damages. Wausau’s complaint contends that damage to the golf course is not covered by the club’s insurance policy.

In May and June, McAuley filed claims to cover alleged damage to nine holes of the 27-hole golf course during preliminary work to clean up the site.

Earlier this year, a Superior Court judge halted the $26.5-million cleanup project and ordered the state to complete a full environmental impact study because Kern County residents objected to receiving the toxic wastes.
