Alhambra : Renewal Ruling Upheld

The state Court of Appeal has upheld a Los Angeles Superior Court decision that rejected a legal challenge to the inclusion of most property along Main Street in a redevelopment district.

The suit, filed by Richard Carman of San Gabriel and Alhambra businessman James Fosselman, contended that the city’s major business street is not blighted and does not qualify for redevelopment assistance. The Court of Appeal agreed with Superior Court Judge Lester Olson, who said the Alhambra City Council acted on “substantial evidence” to draw the redevelopment-area boundaries and that the court did not need to examine the area itself to determine if it was blighted.
