A lawyer for longtime fugitive attorney Stephen Bingham accused two former San Quentin guards of altering their testimony to fit the prosecution’s theory that Bingham smuggled a pistol to black activist inmate George Jackson just before the 1971 prison riot in which Jackson, two other inmates and three guards were killed. In his closing argument, Gerald Schwartzbach said it was “reasonable” to infer that “somebody or somebodies in law enforcement” wanted Jackson to think he could escape so he could be killed. Bingham, 44, is charged in Marin County Superior Court with two counts of murder and one count of conspiracy.
