Central County : Retailers Sue to Lift Alcohol Sales Limits
A trade group representing 3,000 convenience stores sued the cities of Garden Grove and Los Alamitos on Tuesday, challenging ordinances prohibiting the sale of alcohol at locations where gasoline is sold.
The suits were filed in Superior Court by Food and Fuel Retailers for Economic Equality, a group representing convenience store operators in California.
The group claimed that the ordinances are discriminatory and retroactive and violate constitutional guarantees of due process and equal protection of the law. The suit also alleges that only the state has the power to regulate the sale of alcoholic beverages.
The group sought a court order blocking the ordinances and a declaration that they are invalid and unenforceable.
The lawsuits are nearly identical and challenge ordinances in both cities that were enacted in February, according to the suit.
