Suit Seeks Payment for Work on Pier
The construction firm that rebuilt the San Clemente Pier after it was ravaged by winter storms in 1983 filed a lawsuit Tuesday claiming that the city has failed to pay $350,000 for the work.
Healy Tibbitts Construction Co. alleged in the Superior Court lawsuit that the city has refused its demands for complete payment for the job.
The firm claimed that problems with reconstruction of the pier stemmed from a city employee’s failure to properly manage the repair work.
At first, the pier was not constructed high enough over the ocean, requiring corrective work, according to the suit.
The firm said it relied on the city supervisor’s approval of the work as it progressed. The city, which paid the firm more than $750,000, should also pay for the unexpected cost, Healy Tibbitts lawyers claimed.
The pier was reopened June 22, 1985. A spokesman for the city could not be reached for comment.
