Jurors in Santa Clara County Superior Court heard opening arguments in a $3-million lawsuit against Cutter Laboratories by the family of Los Gatos attorney Daniel Gallagher, who died in 1984 after contracting AIDS, allegedly from a contaminated blood clotting agent marketed by Cutter. Jim Towery, attorney for the family, said Gallagher could have changed to another medication if Cutter had advised customers that its product could be tainted with AIDS. But Cutter attorney Duncan Barr said Gallagher could have contracted the disease before it became known that hemophiliacs were at risk.
