McMartin prosecutor Lael Rubin has admitted that she delayed telling defense attorneys that the mother of the child who triggered the preschool sex abuse case had also named school board member Roberta Weintraub as one of several people who molested him. The deputy district attorney, called as a witness by the defense, said she intended to ponder for “a few days . . . the impact of that information on a public figure,” but that because of negligence on her part the paper documenting the allegation was not turned over to the defense for nearly a year. Defense attorney Danny Davis contended that Rubin “intentionally” suppressed evidence that might exonerate his client, Ray Buckey. If Los Angeles Superior Court Judge William Pounders determines that the district attorney’s office deliberately withheld evidence he could dismiss the single criminal count involving that child.
