Judge Won’t Allow Diary as Evidence in N.Y. Sex Slaying

A state judge today ruled in favor of the family of a young woman killed in a Central Park sex session, saying attorneys for the “preppie” accused of murdering her cannot introduce her “kinky” diary into evidence.

Lawyers for Robert Chambers, 20, claimed the diary chronicled the far-out sexual activities of Jennifer Levin, 18, but State Supreme Court Justice Howard Bell said he quashed the subpoena because the diary’s contents had no judicial relevance to the case.

“Today’s decision puts the judicial focus where it belongs--on the conduct of the killer and not the character of the victim,” said Jeffrey Newman, a lawyer for the Levin family.

Defense attorney Roger Stavis said he will appeal the decision.

Bell read the diary alone in a jury room for 3 1/2 hours before handing it back to Newman pending his decision on whether to allow Chambers’ lawyer to read it.
