Dismiss North Suit, Walsh Motion Asks
Independent counsel Lawrence E. Walsh asked the U.S. District Court today to dismiss a lawsuit filed by Lt. Col. Oliver L. North which seeks to halt the criminal investigation of the Iran- contra affair.
In a 45-page legal memorandum, Walsh called North’s suit “a considered attempt to disrupt the ongoing criminal investigation.”
Walsh’s memo said that as long as North’s suit is pending, “it invites potential witnesses to withhold cooperation. . . . The mere tendency of this action may irreparably injure the ongoing criminal investigation.”
Walsh was not joined in his motion by Atty. Gen. Edwin Meese III, who also is a defendant in the lawsuit that North filed Feb. 24.
North was fired Nov. 25 as a deputy on the staff of the National Security Council.
