Newport Beach : Judge Blocks Addition That Would Block View

A Newport Beach couple won a court order Thursday that temporarily prohibits a neighbor from building a two-room addition that would block the ocean view from their $630,000 house.

Diana and Edward Prosser claimed their home would lose $100,000 to $150,000 in value unless the building project was stopped.

Orange County Superior Court Commissioner Eleanor M. Palk issued a temporary restraining order halting work pending a full hearing, which is set for March 31.

The Prossers live in the 300 block of Cameo Shores Drive in Corona del Mar. Palk’s order was issued against Peri Corso and Stephen M. Schwartz, identified as the owners of the house next door.

“This view obstruction will be permanent and will substantially diminish the value of my property,” Diana Prosser said in a sworn statement. “It will also significantly impair my enjoyment and use of my property.”

The Prossers also named as defendants the Cameo Community Assn., claiming the homeowners’ organization wrongfully approved the construction.
