K mart and others settled a dispute with Guess.

The discount chain; Fashion House, one of its suppliers, and Jeff Hamilton, a former Guess licensee, agreed to pay a total of $2.3 million to Guess to settle a lawsuit filed by the Los Angeles-based jeans maker in September, 1985. Guess had alleged that the defendants conspired to change labels and sell men’s jeans as women’s jeans. As part of the settlement, reached on the eve of a trial, K mart will also return to Guess 18,000 pairs of jeans, according to Paul Marciano of Guess.

On April 22, The Times reported that Jeff Hamilton, a former Guess licensee, had agreed with Fashion House and K mart to pay a total of $2.3 million to the Los Angeles-based jeans maker to settle a federal lawsuit. The suit alleged a conspiracy to change labels and sell men’s Guess jeans as women’s jeans. In fact, there were three separate lawsuits involving Guess and Hamilton, including the federal suit. Hamilton did not pay any money to Guess to settle the federal suit. However, Hamilton did contribute $95,000 toward settlement of two state lawsuits involving breach of contract and trademark infringement allegations.
