After presenting 47 witnesses in the Sagon Penn retrial, the prosecution plans to rest its case today.

The defense is expected to begin today after Penn’s attorney, Milton Silverman, finishes his cross-examination of a criminalist who testified Wednesday.

Deputy Dist. Atty. Wayne Mayer told reporters that the prosecution intends to rest after Silverman finishes with its last witness.

One of the prosecution’s last witnesses Wednesday was Bruce Koenig, an FBI agent who specializes in tape recordings. He analyzed the recording of a 911 call in which he claimed the six shots could be heard.

Penn was acquitted of murder June 26 and is being retried on manslaughter, attempted murder, attempted manslaughter and assault with a deadly weapon. The charges stem from a March 31, 1985, altercation in an Encanto driveway in which one policeman was killed, another was wounded and a civilian with them was also wounded.
