Citing “constitutional abuse” and “political censorship,” officials of the Los Angeles-based Pacifica Foundation said Thursday it will fight the Federal Communications Commission in court over charges that radio station KPFK-FM broadcast obscene programming. Pacifica said it plans to file suit in Washington federal court seeking to set aside last week’s FCC warning and threat to criminally prosecute the nonprofit station for its August, 1986, broadcast of “Jerker,” a play about homosexuality and AIDS. The suit is not expected to be filed for at least 10 days, officials said, because Pacifica is still awaiting formal notification of the FCC’s action.
