Anaheim : Judge Allows Police to Cite Vendors for Music

The way was cleared Monday for police to crack down on street vendors who use amplified music to attract customers.

Superior Court Judge Gary L. Taylor dissolved an earlier court order that had blocked enforcement of Anaheim’s ordinance against the music. That order had halted enforcement on March 9.

A group of 17 family businesses, called the Union de Comerciantes Latinos del Sur de California, had claimed that the city was trying to regulate them out of business. A judge issued a temporary restraining order in the vendors’ favor pending a full hearing before Taylor.

The city had enacted the ordinance after receiving widespread complaints from residents who said they were bothered by the music, according to Assistant City Atty. Malcolm Slaughter.

“We had people who said they couldn’t talk on the phone because of the noise,” Slaughter said.

Six citations for violation of the ordinance were issued before the temporary halt in enforcement, Slaughter said.
