A judge allowed a negligence lawsuit against the county involving child molestation to proceed Tuesday even though the suit was filed after a court deadline.

The father of three boys in Campo who were allegedly molested by a cult leader filed a petition in San Diego Superior Court on July 28 seeking permission to sue the county because the boys were placed in the custody of the molester.

The father, a 41-year-old Navy sonar technician, was at sea when the children’s mother had a nervous breakdown in January, 1985, and the boys were placed in the care of Herbert Beierle, 59, of Campo.

Beierle, who ran the God Unlimited University of Healing in Campo, is serving 42 years in state prison for molesting the youngest of the three boys, who is 10.

Judge Andrew Wagner allowed the suit to be filed after the father’s attorney, William Fuhrman, appeared in court Tuesday. The statute of limitations would have disqualified the suit had Wagner not granted the father’s petition.

Fuhrman said he intends to file the suit next week and name the county, its Child Protective Services division, God Unlimited University, Beierle, and some of Beierle’s followers as co-defendants.
