P. V. Estates : Ventilator Removed

A conspicuous garage ventilation system has been removed from the top of an 18-unit condominium on Via Campesina in Malaga Cove and city officials say they are satisfied. Gary Wynn, city building inspector, said developer Nick Olar has replaced the rooftop system with one inside the garage. “The only thing on top of the building is an additional chimney,” he said.

Neighbors said the old system was ugly, and the City Council in February temporarily stopped issuing occupancy permits until the system was changed.

Olar, however, is not satisfied. His attorney, Larry Burge, said the developer plans to sue the city for wrongful denial of the occupancy permits. Olar filed a $3-million claim against the city, which was rejected, and he has until November to file suit, Burge said.
