Judge Bork’s Supreme Court Confirmation Hearing

Share

Bork told the committee, “It is one thing as a legal theorist to criticize the reasoning of a prior decision. . . . It is another and more serious thing altogether for a judge to ignore or overturn a prior decision. That much requires much careful thought.”

When he’s instructing aspiring lawyers and writing and speaking to persuade his compatriots and advancing his theories to government decision makers, he’s not really giving it his best shot? Am I to understand that he conserves his powerful brain only for ignoring or overturning prior decisions?

My, my. If Ronald Reagan were alive today he’d be turning over in his grave.
