Burbank Agency Asks Dismissal of MCA Suit

Attorneys for the Burbank Redevelopment Agency asked the Los Angeles Superior Court on Thursday to uphold a tentative agreement between the city and Walt Disney Co. for development of a multimillion-dollar entertainment and retail complex.

The agency asked the court to dismiss a lawsuit filed by MCA, an entertainment conglomerate that seeks to invalidate the agreement giving Disney exclusive negotiating rights to build the project in downtown Burbank. A court hearing was scheduled for Nov. 13.

MCA claims that the city failed to provide an environmental-impact report and did not specify the costs of the project.

Senior Assistant City Atty. Richard W. Marston said MCA’s claims are erroneous and the request is premature because the agreement has not been formalized.

MCA filed another lawsuit claiming that the agreement was completed behind closed doors, which would be a violation of state law. MCA has said it wants to submit a competing proposal.
