Deaver Leaves Hospital; Trial to Resume

Lobbyist Michael K. Deaver was discharged Monday from a hospital after emergency treatment for kidney stones and will be in court today when his perjury trial is resumed, his lawyer said.

Defense lawyer Randall J. Turk said the former presidential aide “sounds tired but he also wants to be there” today. The trial, in recess Monday, is scheduled to be resumed before U.S. District Judge Thomas Penfield Jackson.

Deaver is charged with lying under oath about his lobbying activities. He was taken to Georgetown University Hospital after he doubled over in pain Saturday.

Turk said doctors did not know whether Deaver had passed the kidney stones but decided to discharge him when he said he was feeling better. Deaver’s doctors put off any decision on whether to perform further treatments, Turk said.

The defense has raised Deaver’s health as an issue at the trial. Deaver, a recovering alcoholic, was treated for the disease in June, 1985, and again in the fall of 1986, several months after he was questioned by a grand jury and a House subcommittee investigating his lobbying activities for alleged ethics law violations.

In a related development, a three-judge panel of the U.S. Circuit Court of Appeals considering the constitutionality of the special prosecutor law ordered a Justice Department account of independent counsel Whitney North Seymour Jr.’s dispute with Canada stricken from the record of the case it is reviewing. The panel ruled that the account was improperly submitted.
