The United Steelworkers’ charges that police and Phelps Dodge Corp. conspired to violate copper mine strikers’ civil rights through discriminatory law enforcement, excessive bail and arrests without legal cause were rejected by the U.S. 9th Circuit Court of Appeals in San Francisco. Evidence of close connections between police and Phelps Dodge Corp. employees reflected only “the realities of small-town life,” the court said in a 2-1 decision. The suit involved the company’s mine at Ajo, Ariz., that was one of four sites hit by a strike in July, 1983.
