An 81-year-old former Nazi Waffen SS captain accused in the mass murder of 161 Polish civilians was found to be too ill to stand trial, and a court Wednesday dismissed the case.

Medical experts testified that the health of Friedrich Paulus had deteriorated through old age beyond the point where he could defend himself. Paulus, who was brought to court in a wheelchair, lost a leg in the war.

Paulus was accused of participating in the mass execution of 161 Polish civilians in 1940 near Lublin as the Nazis retaliated for the alleged murder of a German family by Polish partisans.
