Driver Runs Afoul of Letter of the Law

A judge ordered John Gerald Smith released from jail after officials determined that they had arrested the wrong John G. Smith on drunk-driving charges.

“It appears they arrested the wrong man,” Roger Fish, assistant district attorney, told General Sessions Judge John Brown. Smith, 32, had been held 11 days in the Metro Nashville Jail on a warrant for the arrest of John G. Smith.

But authorities determined Monday that the warrant was for John Gregory Smith, 31, charged with drunk driving last Feb. 14 and released on $1,000 bond. John Gregory Smith failed to appear; his bond was forfeited, and an order was issued for his arrest.
