The illegal-lobbying case against former presidential aide Lyn Nofziger went to the jury today after the judge excused one member of the panel who had fallen asleep during final arguments.

U.S. District Judge Thomas A. Flannery excused juror Muriel Nicely and replaced her with alternate Harry Van Pressley after complaints from a defense attorney that Nicely had fallen asleep during final arguments Tuesday. Outside the U.S. Courthouse where he is being tried on charges of illegally lobbying former White House colleagues for private clients, the former presidential aide told reporters, “I’ve got a lot of confidence and I think things are going to turn out all right.”
