No Retrial for Hurricane Carter

New Jersey has decided not to try Rubin (Hurricane) Carter a third time for murder, a prosecutor said today, ending the former boxer’s 22-year legal saga.

Prosecutor John Goceljak said his office was filing a motion in Superior Court in Paterson to dismiss the indictment against Carter and John Artis, accused of being his accomplice. Goceljak said the decision was based on the long period since the 1966 slayings, the unavailability of some witnesses, the likely exclusion of the only eyewitness testimony and the decision by a federal judge who found that Carter’s conviction was racially tainted.
