Alpha Microsystems said it has settled its copyright infringement suit against d/Soft Ltd., a New Jersey software firm, in a deal that also ends d/Soft’s antitrust claim against Santa Ana-based Alpha Micro. The suit, filed by Alpha Micro on Aug. 4, 1987, in U.S. District Court in Los Angeles, accused d/Soft of copying Alpha Micro’s popular “AMOS” computer operating system and marketing its own version as the “d/OS” operating system. The settlement announced Thursday includes a permanent injunction under which d/Soft will cease distribution and sales of the d/OS system. The agreement calls for Alpha Micro to retain d/Soft to provide software development consulting services for the next three years and also calls for Alpha Micro and d/Soft to jointly provide support services to licensed users of the AMOS system. An operating system is the internal software that dictates how a computer will collect and process data. An Alpha Micro official declined further comment on the settlement and d/Soft officials in New Jersey could not be reached for comment.
