City Will Not Appeal Ruling in Bias Case
Glendale city officials decided Tuesday not to appeal a federal appellate court ruling requiring the promotion of a Latino police officer who won a racial discrimination lawsuit against the city in 1986.
“It is probably something that we just can’t win,” Mayor Carl W. Raggio said. “We want to put it in back of us and get back to work.”
Last week, the U.S. 9th Circuit Court of Appeal upheld a 1986 lower-court ruling that the Police Department discriminated against Ricardo L. Jauregui, a 15-year veteran of the force. The appeals court also affirmed the U.S. District Court order to promote Jauregui to sergeant with back pay to February, 1985.
Jauregui was passed up for promotion seven times for jobs that went to Anglo applicants. He filed suit after promotion of an officer who has since admitted to drawing and circulating racially derogatory cartoons in the Police Department.
Glendale City Atty. Frank R. Manzano said Jauregui will be appointed to the post, given the retroactive pay--an estimated $18,000--and reimbursed for legal fees immediately.
