Local News in Brief : San Clemente : Court Asked to Overturn Slow-Growth Initiative

A group of San Clemente developers Wednesday asked a Superior Court judge to declare invalid the city’s slow-growth initiative approved by voters in June.

Judge John C. Woolley took the matter under submission and did not indicate when he would issue a ruling.

Marblehead, a limited development partnership, argued that the initiative is unenforceable and that it prevents the city from taking its fair share of housing in the region, according to Richard Duncan, the group’s attorney.

According to court documents, city officials contend that the court action is premature because the initiative has not gone into effect and that the developers have misinterpreted the impact the measure will have.
